A Pennsylvania federal judge has sent a lawsuit against Elon Musk and his political action committee back to state court, paving the way for a potential injunction to block the daily $1 million prizes awarded to registered voters.

Accusations of Illegal Lottery and Voter Influence

Philadelphia District Attorney Larry Krasner accuses Musk and his America PAC of operating an illegal lottery and attempting to influence voters in the presidential election between Donald Trump and Kamala Harris. The lawsuit also alleges violations of state consumer protection laws.

Federal Court Dismissal

U.S. District Judge Gerald Pappert dismissed arguments by Musk’s lawyers that the suit should be handled in federal court, citing the lack of federal law questions involved. The judge ruled that the legal issues arise from state law, not federal law.

State Court Showdown

Krasner’s office welcomes the ruling, calling it “consistent with the argument of the District Attorney.” An attorney representing Krasner’s office is now awaiting a state court hearing to consider an emergency request to halt the $1 million lottery.

Musk’s Controversial Giveaway

Musk announced on October 19 that his PAC would randomly award $1 million per day until Election Day to registered voters in seven swing states, including Pennsylvania, who signed a petition supporting the U.S. Constitution. The first three prize winners were from Pennsylvania.

Legal Battle Ahead

With the case back in state court, Musk and his PAC face a potentially quick order blocking the giveaway in Pennsylvania. The legal battle is far from over, with both sides gearing up for a fight over the legitimacy of the daily prizes.
