Trump Seeks Dismissal of Georgia Criminal Case Ahead of Inauguration

Trump’s Lawyers Push to Dismiss Criminal Case in Georgia

As the presidential inauguration approaches, Donald Trump’s legal team is making a bold move to dismiss the criminal case against him in Georgia. On Wednesday, Trump’s lawyer Steven Sadow filed a motion with the Georgia Court of Appeals, arguing that the court lacks jurisdiction over the case and should direct the trial-level state court in Atlanta to “immediately dismiss” the indictment.

Immunity Claim

Sadow’s argument hinges on the claim that a sitting president is completely immune from indictment or any criminal process, state or federal, under the U.S. Constitution. Although Trump won’t be sworn in until January 20, Sadow believes the appeals court should “inquire into its jurisdiction” and decide that both the appeals court and the trial court lack jurisdiction to continue the case.

This development comes on the heels of a similar argument made by another Trump defense attorney in a New York state court, seeking to dismiss the criminal hush money case against him. Additionally, special counsel Jack Smith recently dropped two federal criminal prosecutions of Trump due to his electoral victory, leaving only two criminal cases pending against him.

Background of the Case

The criminal case in Georgia stems from Trump’s efforts to overturn his defeat in the state’s 2020 presidential election. The case has been on hold since before the election, with Trump attempting to disqualify Fulton County District Attorney Fani Willis due to her romantic relationship with a prosecutor on her team.

What’s Next?

As the legal battle unfolds, it remains to be seen how the Georgia Court of Appeals will respond to Trump’s lawyers’ motion. One thing is certain, however: this development marks a significant turning point in the ongoing saga of Trump’s legal troubles.
