OpenAI, the Microsoft-backed artificial intelligence firm, has fired back at allegations of copyright infringement in an Indian court, arguing that any order to remove training data powering its ChatGPT service would be at odds with its legal obligations in the United States.
A Wave of Lawsuits Over AI Misuse
The lawsuit, brought by local news agency ANI, accuses OpenAI of using published content without permission to train ChatGPT. This is not an isolated incident; OpenAI and other firms have faced a surge of similar lawsuits from prominent copyright owners over alleged misuse of their work to train AI models.
Fair Use or Copyright Breach?
OpenAI has consistently denied the allegations, claiming its AI systems make fair use of publicly available data. However, ANI argues that its published works were stored in ChatGPT’s memory and should be deleted. The Delhi High Court is set to hear the case on January 28.
Jurisdictional Dispute
In its 86-page filing, OpenAI asserts that it is not within the jurisdiction of Indian courts to hear the case, as it has no presence in the country. The company claims that its servers, which store the training data, are situated outside of India.
Preserving Training Data
OpenAI also argues that it is legally obligated to preserve the training data while litigation is pending in the United States. This obligation stems from laws in the US that require the preservation of data during ongoing hearings.
ANI Fires Back
ANI, in which Reuters holds a 26% interest, has stated that it believes the Delhi court has jurisdiction to decide on the matter and will file a detailed response. The news agency is concerned about unfair competition, given OpenAI’s commercial partnerships with other news organizations.
