Historic Win for Public Workers: Social Security Fairness Act Signed into Law
In a landmark move, President Joe Biden has signed the Social Security Fairness Act, paving the way for nearly 3 million public workers, including teachers, firefighters, and police officers, to receive a significant boost to their Social Security benefits.
Eliminating Unfair Provisions
The new law abolishes two provisions that have been reducing Social Security benefits for certain public workers who receive pensions: the Windfall Elimination Provision (WEP) and the Government Pension Offset (GPO). These provisions, enacted over four decades ago, aimed to ensure that workers who earn public pensions from employment where they didn’t pay into Social Security receive the same payout as those who pay into Social Security throughout their careers.
A New Era for Public Workers
The elimination of WEP and GPO means that over 2.5 million Americans will receive a lump-sum payment of thousands of dollars to make up for the shortfall in benefits they should have received in 2024. As of December 2025, the Congressional Budget Office estimates that:
- 2.1 million beneficiaries will see an average increase of $360 in their monthly Social Security benefits.
- 380,000 spouses will see an average increase of $700 in their monthly benefits.
- 390,000 surviving spouses will see an average increase of $1,190 in their monthly benefits.
Simplifying Retirement Planning
Experts agree that the elimination of WEP and GPO will make retirement planning simpler and less stressful for public workers. The extra income will provide a sense of relief and reduce the pressure to generate income from other assets. Additionally, the complex calculations required by the provisions will no longer be necessary, making it easier for beneficiaries to plan their financial futures.

The Social Security Administration is currently determining the timelines for implementing this new law. Beneficiaries are advised to ensure that the SSA has their current mailing address and direct deposit information on file, which can be updated online or by calling or visiting a Social Security office.
